Referral Programme Terms
These terms apply to the SURE referral programme run by SURE Services Group Pty. Ltd. (ABN 73 673 593 318, ACN 673 593 318), trading as SURE Building Inspections ("SURE", "we", "us"). By joining the programme you agree to these terms. Our general Terms and Conditions and our Privacy Policy also apply.
1. Joining the programme
1.1 You can ask to join by signing in with your email address and accepting these terms. We may ask for details such as your name and phone number, and we may ask you to confirm your identity or other details.
1.2 You need to be at least 18 to join. We may accept or decline an application, and we may set or change who is eligible.
1.3 Real estate and buyer's agents may join with the same account they use for our agent portal. Orders you place through the agent portal after you join may be recorded as your referrals. Orders placed before you join do not earn rewards.
1.4 Joining does not make you our employee, agent, partner or representative. You are not authorised to make any promise or statement on our behalf, or to accept bookings for us.
2. Your code and link
2.1 When you join, we give you a referral code and a share link. We may change, replace or deactivate a code or link, for example to prevent misuse. Where practicable we will give you a replacement.
2.2 You may share your code or link with people who may need an inspection, in line with section 6.
3. How a referral is recorded
3.1 A referral is generally recorded when a customer contacts us or books with your code or link, or when you place an order for them through the agent portal, and we link that customer to you.
3.2 A referral generally stays linked to you for the referral period shown in your account, counted from when it is recorded. Bookings placed after that period generally do not earn a reward.
3.3 Where more than one person refers the same customer, the referral is generally linked to the first person whose referral we recorded, while that referral is current.
3.4 A referral may not be recorded, or may not earn a reward, in circumstances including where the customer is you, someone connected to you, or an existing SURE customer; where the code is not valid or not active; or where we cannot reliably identify the customer.
3.5 We decide whether and to whom a referral is linked, acting reasonably and based on our records. We may link, move, extend or end a referral by hand, for example to correct an error. If you think a referral is missing or wrong, contact us and we will look into it.
4. Earning rewards
4.1 You may earn a reward when a customer you referred completes an eligible inspection. Your rewards are shown in your account as earnings. Unless we tell you otherwise, a reward is generally earned once for each referred customer, on their first completed booking. If that booking is cancelled, a later completed booking within the referral period may earn it instead.
4.2 The reward is a percentage of the price the customer pays for the inspection after any discounts, gifts or credits, excluding GST, at the rate shown in your account when the reward is earned. If the price after discounts is nothing, no reward is earned.
4.3 We may set different rates, rules or limits for different referrers, referrals or bookings, including rewards on more than one booking. Any such arrangement applies only if we confirm it to you.
4.4 Unless we agree otherwise in writing, a reward is the total amount we pay for your referral and includes any GST.
5. Your earnings and withdrawals
5.1 A reward is first shown as pending. It generally becomes available after the holding period shown in your account, counted from when the inspection is completed. We may hold a reward for longer, for example while we review a booking or a price.
5.2 Withdrawals are not open yet. In the meantime your earnings build up in your account, and we will let you know when you can withdraw them.
5.3 Once withdrawals are open, you may ask to withdraw your available earnings when they reach the minimum amount shown in your account. A withdrawal fee shown in your account is deducted from each withdrawal unless we waive it. We may review a withdrawal request before we approve it.
5.4 Withdrawals are paid through our payment provider, currently Stripe. To receive payments you may need to set up an account with that provider, give it the details it asks for, and accept its terms. We are not responsible for the provider's services, checks or decisions, or for delays caused by them or by your bank.
5.5 We do not promise that a withdrawal will be paid within any particular time.
5.6 Your earnings are not money held on trust for you, do not earn interest, and cannot be transferred or exchanged for anything else. We may set off any amount you owe us under these terms against your earnings.
6. How you may refer people
6.1 When you share your code or link, you must:
- act honestly and not make false or misleading statements about SURE, our services, our prices or the programme;
- not suggest you are SURE, or that you work for or speak for SURE;
- comply with laws that apply to you, including laws about marketing messages, spam and privacy; and
- only give us another person's details where you are allowed to.
6.2 You must not refer yourself, create or use false identities or bookings, offer customers payments, cash-back or other incentives we have not approved, or use our name, logos or brand in paid advertising (including bidding on them in search ads) without our written permission.
6.3 We may ask you to change or stop any activity that we reasonably consider is not in keeping with these terms or may harm our reputation.
7. Your own obligations
7.1 You are responsible for your own legal, tax, licensing, professional and disclosure obligations in connection with the programme. Depending on your circumstances, these may include a duty to tell your clients or customers that you may receive a referral fee from us, and rules set by any industry body or licensing authority you belong to.
7.2 We do not give legal, tax, financial or licensing advice and do not check whether you have met your obligations. You may wish to get your own advice.
8. Tax
8.1 You are responsible for any tax that applies to rewards you receive, including income tax and GST.
8.2 We may ask for your ABN, GST registration status or other tax details before paying you. If you do not give us an ABN where the law requires one, we may withhold an amount from a payment and pay it to the Australian Taxation Office as the law requires.
8.3 If we ask and you agree, we may issue recipient-created tax invoices for rewards, and you agree not to issue your own tax invoices for those rewards.
8.4 We may give information about rewards paid to government authorities where the law requires or permits it.
9. Withholding, reversing and adjusting rewards
9.1 We may withhold, hold, reduce, reverse, adjust or cancel a reward or earnings, in circumstances including where:
- the booking is cancelled, refunded, disputed, reopened or not paid;
- we made an error, or a price or detail changes;
- we reasonably suspect fraud, misuse, self-referral or a breach of these terms; or
- the law requires it.
9.2 This may happen after a reward has become available or been withdrawn. If it takes your earnings below zero, the shortfall generally carries forward against future rewards, you may not be able to withdraw while your earnings are below zero, and we may ask you to repay it.
10. Leaving the programme, suspension and removal
10.1 You may leave the programme at any time by contacting us.
10.2 We may suspend you or remove you from the programme, including if we reasonably believe you have breached these terms or the programme is being misused. Where practicable we will tell you why, and give you a chance to respond, before we do so.
10.3 When you leave or are removed, your code and link stop working and referrals linked to you end. Pending rewards may be cancelled. Available earnings, after any amount you owe us is set off, will be paid to you once withdrawals are open, subject to section 9 and to you completing the payment provider's set-up.
11. Changes to the programme and these terms
11.1 We may change, suspend or end the programme, or any part of it. This includes changing rates, fees, minimum amounts, holding periods, referral periods, eligibility, and the form of rewards and how they are calculated or paid, for example moving from money to points.
11.2 We will give you reasonable notice of a change that is likely to disadvantage you, by email or in your account, unless we need to act sooner for legal, security or fraud reasons. A change generally applies to rewards earned after it takes effect. We may ask you to accept updated terms before you continue in the programme. If you do not agree to a change, you may leave the programme under section 10.
11.3 We will post the current version of these terms on this page.
12. Liability
12.1 Nothing in these terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law.
12.2 To the extent permitted by law, we are not liable for any indirect or consequential loss, or for any loss arising from the programme being changed, suspended or ended, a referral not being recorded, or a payment provider's acts or delays, and our total liability in connection with the programme is limited to the amount of the reward concerned.
12.3 To the extent permitted by law, you indemnify us against loss we suffer to the extent it is caused by your breach of these terms or of any law in connection with the programme.
13. Privacy
13.1 We handle personal information in connection with the programme as set out in our Privacy Policy, including its Referral programme section. You will not receive the contact details of people you refer. We may show you their first name and last initial and the general status of a referral.
14. General
14.1 You may not transfer your membership, code or earnings to anyone else. We may transfer our rights and obligations under these terms, for example to a related business or to a buyer of our business.
14.2 If any part of these terms is invalid or unenforceable, it is read down or severed to the extent required and the rest continues to apply.
14.3 If we do not enforce a term straight away, we can still enforce it later.
14.4 These terms are governed by the laws of Western Australia. You and we submit to the non-exclusive jurisdiction of its courts.
